A Call Out fee of $75 is applicable to all site visits except those listed below:

• $55 Call Out fee for properties within 10 km of Epping ($20 Discount). See included suburbs
• Properties in excess of 25 km from Epping may be charged tolls or a per kilometer rate. Contact us for details.
• The Call Out fee is applied each time the site is visited.
• If we are required to pick up and return the key to the Agency there is a $20 fee. This fee is dependent on the Agency location being no further than 5 Kilometres from the property. Longer distance may be charged more.

• If paid car parking is required this cost will be passed on to the customer. Provide Visitor Parking where possible.
• Multiple services can be booked per Call Out. Schedule permitting.
• If we can’t perform all the services ordered at the scheduled time, an additional Call Out may be required incurring an additional Call Out fee.

We capture images of the property as it presents at the time of the booking.
Any cleaning or decluttering will be solely at our discretion and should not be the expectation.
The property must be ready to be photographed and/or videoed at the start of the assigned booking time.
Any retouching required may incur additional expense, except where stated. Contact us for more details.

Terms of Service

Real Estate Photo and Related Services

Retouching Turning on lights with dead light bulbs, decluttering, lawn repair and the like starts at $10 per photo. If image retouching is required this may extend the delivery time by up to one full working day. Quote available on request.

Staff Portraits $75 for the first staff member. Each staff portrait, or photograph, thereafter is $45.

Terms of Service

1. All bookings will be confirmed by Nathan James Photography and Videography, prior to attending appointment.
2. New clients will be required to pay pro forma invoicing, upfront, in total. This condition will be waived only at our discretion. Once we have established a payment history the client will be put on payment terms of 7 days from date of invoice. Establishment of payment history will be at our discretion.
3. In the case of cancellation of less than 2 full working days, payment is not refundable. This condition will be waived only at our discretion. Where practical rescheduling may be arranged, however this will be determined by our schedule and at our discretion.
4. Cancellation of more than 2 full working days but less than 5 full working days, will receive a 50% refund.
5. Cancellation of more than 5 full working days will receive a 90% refund.
6. Only after you, the client, has paid in full the total amount due as stated on the invoice, will you, the client, have the right to use the images. Payment of the deposit alone, does not grant you, the client, the right to use the images and/or digital content, produced by us, Nathan James Photograph and Videography. Any breach of this term will result in it being report to the IPTC (International Press Telecommunications Council) as a breach of copywrite.
7. At our discretion the booking may be rescheduled. Rescheduling may result in additional charges.
8. All products and services will be delivered with in the time frame as outlined in the Pricing and Terms (above). Except for new customers who have ordered multiple services with varying delivery times. In this case final delivery of images will require payment in full for all services ordered even if some services have not yet been completed. For example if photos and video have been ordered where photos have a delivery time of one full working day and the video have a delivery time of 3 full working days, final delivery of the photos will require payment in full for both services before they are delivered, even if the video is not yet ready for delivery.
9. Delivery times do not include weekends or public holidays. Working Days are considered to be non public holiday days, Monday to Friday.
10. We accept no obligation to provide service that were not agreed to prior to the Call Out date and time. It is you, the client, who is solely responsible for advising us, Nathan James Photography and Videography, of services required to be performed during a Call Out.
11. If paid car parking is required this cost will be passed on to the customer.
12. All fees for service are inclusive of GST.
13. It is the responsibility of you (our client), as your client representative to advise your clients of appropriate appointment times.
14. You, as the client, should ensure the site of the Photo/video shoot is in compliance with NSW Work Health and Safety requirements. Failure to do so may, at our discretion, be treated as a cancellation initiated by you, the client. In this scenario the deposit will be seen as the cancellation fee and be retained by us, Nathan James Photography and Videography.
15. You understand that we do not provide a cleaning service nor accept any obligation to touch or move personal effects. Any decluttering will be done at our discretion. We accept no obligation to provide cleaning services and you accept we will photograph/video the premises as it presents on the date and time of the booking.
16. You understand that we will not digitally alter or remove existing fixed features of a property like powerlines, damage to walls and drainage pipes in line with Australian law relating to the advertising and display of promotional images and marketing collateral (any digital or printed material used to communicate or promote a company’s brand message, products, or services). We may digitally enhance lawns and sky. Digital object removal will incur an additional cost.
17. It is the customers responsibility to sign off on all shots taken during the photoshoot, in regard to the perspective, angle and composition of the photos taken. In the scenario that the customer is not available to sign off on photos perspective, angle and composition it will be at the photographers discretion. If the customer requires different perspectives, angles and composition, it will require a reshoot, another Call Out fee will be charged and the new photos will be charged for in addition to the photos already taken.
18. Images will be supplied in low-res and/or watermarked, until full payment itemised on the invoice has been made at which time the high-res images without a watermark will be released.
19. Cancellation will result in 50% of the total scheduled package price being charged as a late cancellation fee. This amount will be deducted from the deposit and an invoice issued for the money outstanding. At our discretion the customer may be reschedule the booking. Rescheduling may result in additional charges.
20. If a property is unattended at the time of our arrival and access is not possible, and instructions have not been received from you, the client, a cancellation fee will be charged at 50% of the total booked value. This amount will be deducted from the deposit and an invoice issued for the money outstanding.
21. A late fee of $15 every 15 minutes or part thereof will be charged if the property is unattended or if we are unable to start the work. In this circumstance where a property is unattended, or can not be access, or where we have been given no instructions relating to an unattended property we will consider this a late cancellation. At our discretion we may consider an unattended property grounds for cancellation and charge 50% of the total scheduled package price as a late cancellation fee. This amount will be deducted from the deposit and an invoice issued for any money outstanding.
22. Camera perspectives will be in line with those demonstrated in my portfolio unless specifically instructed otherwise. Linked to here.
23. Payment in full will be seen of acceptance by you that the work done is of satisfactory quality. Once final images are delivered there will be no refund based on the service not being completed as of satisfactory quality.
24. Refunds will not be provided if the images have been delivered in accordance with our Terms of Service. In cases where a claim is made about the service quality not meeting satisfactory criteria, but the criteria stated conflict with our terms of service, no refund will be considered. Thus, if you, as the client, believe that the services were not delivered to satisfactory quality based on reasons that contradict our Terms of Service, a refund will not be considered.
25. Payment must be made in accordance to the terms set out on the invoice particulars.
26. Cancelling due to weather conditions will be treated as any other cancellation and charged 50% of the total scheduled price as a cancellation fee. This amount will be deducted from the deposit, or any payment already made, and an invoice issued for any money outstanding.
27. Drones can not be flown if it is raining or in extremely windy conditions. If work can not be carried out by us for this reason resulting in the requirement of returning to the property at a later time an additional Call Out fee will be charged.
28. Nathan James Photography and Videography, retain the right to use any and all content created by us during the provision of services, for the purposes of promotion of Nathan James Photography and Videography, and as part of Nathan Hallifax’s portfolio. The purposes of promotion include the right to display in all print and online media platforms owned and controlled by Nathan James Photography and Videography and/or Nathan Hallifax. At your request, as the customer, we will refrain from using the images for the aforementioned purpose for up to 90 days.
29. You (the paying customer) are granted a single irrevocable, royalty free license to use any and all visual content created by us during the provision of services, upon payment in full, in all media throughout Australia and International for any purpose. Only you (the paying customer) can transfer the right to use the media supplied by us (Nathan James Photography and Video).
30. For audio content supplied by us as part of the End Product that is, or includes, an Audio Item, you are granted a license to use the Audio Item on a non-exclusive, commercial, worldwide and revocable basis, for one Single Use. This Single Use is the use as part of the, content created by us during the provision of services, End Product (requiring an application of skill and effort). The End Product consists of a sync of the content created by us, during the provision of services, audio-visual or audio-only work, that incorporates the Audio Item as well as other things, so that it is larger in scope and different in nature than the Audio Item alone.
31. You agree to inspect all services and/ or products and notify us of any defects within 5 working days of the creation of the services and/ or products, failing which we will have no liability for any defects.
